Terms of Service

Important: Replace every bracketed placeholder before public launch. These terms are tailored to the current product shape, but they still require legal review.

1. Provider

StayConcierge is provided by Novera GmbH, Kartonstrasse 7, CH-9425 Thal, Switzerland, reachable at info@novera.ch.

2. Service

StayConcierge provides a web-based host dashboard and guest guide system that lets hosts publish property information, WiFi details, rules, local tips, QR links, and related guest-facing content.

Some features may be in beta, limited release, or manual rollout. Premium onboarding and custom service tiers are handled through direct contact instead of a self-serve purchase flow.

3. Eligibility and Accounts

You must provide accurate registration information and keep your login credentials secure. You are responsible for all activity that happens under your account.

You may not use the service for unlawful, fraudulent, abusive, infringing, or misleading activity.

4. Customer Content and Host Responsibility

Hosts are responsible for the legality, accuracy, and appropriateness of any content they publish, including guest instructions, WiFi credentials, rules, recommendations, support contact details, and any third-party links.

You must not upload content that infringes intellectual property rights, violates privacy rights, contains malware, or exposes sensitive personal data that is unnecessary for the guest experience.

5. Plans, Billing, and Cancellation

Paid plans, limits, and included features are described on the website or in direct written communication. Pricing and packaging may change before or after public launch.

Self-serve payments are processed by Stripe. Subscription status, downgrades, renewals, and cancellation behavior follow the active billing configuration and checkout terms shown at purchase time.

If a subscription is canceled, paid features remain available until the current paid period ends unless otherwise stated.

6. Acceptable Use

You may not probe, scan, or bypass security controls, scrape data without permission, interfere with service operation, or access content that you are not authorized to access.

You may not use StayConcierge to transmit spam, harmful code, deceptive content, or regulated content that the service is not designed to support.

7. Availability and Changes

We may improve, modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability, exact compatibility with every browser/device, or that every beta feature will remain available.

We may introduce plan gating, rate limits, onboarding limits, or manual review steps when needed to protect service quality or prevent abuse.

8. Third-Party Services

The service relies on third-party providers including Supabase, Stripe, Google Analytics after consent, Google Fonts, and CDN providers. Their outages or policy changes may affect service behavior.

9. Intellectual Property

We retain all rights in the StayConcierge software, brand, content templates, and service materials. You retain rights in your own content, but you grant us the limited rights needed to host, process, back up, and display it to provide the service.

10. Confidentiality and Data Protection

We process personal data as described in the Privacy Policy. You remain responsible for ensuring that your use of the service and the content you publish comply with applicable privacy and consumer protection rules.

11. Disclaimer

The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the service will be error-free, uninterrupted, or suitable for every business process.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of bookings, loss of data, or reputational harm arising from use of the service.

Where liability cannot be excluded, our aggregate liability is limited to the fees paid by you for the service during the twelve months preceding the event that gave rise to the claim.

13. Suspension and Termination

We may suspend or terminate accounts that violate these terms, threaten platform security, create legal exposure, or repeatedly misuse the service.

You may stop using the service at any time. Deleting an account does not automatically cancel obligations already due.

14. Governing Law and Venue

These Terms are governed by the laws of Switzerland, excluding conflict-of-law rules. If mandatory law allows a contractual venue, disputes shall be handled at the registered office of Novera GmbH in Thal unless applicable law requires another venue.

15. Changes to These Terms

We may update these Terms to reflect changes in the service, business model, or legal obligations. Continued use of the service after an update becomes effective means you accept the revised Terms.
